1. Who We Are
Kaash (“the Platform”) is a personal weekend project built to make financial literacy more useful — specifically, to help people understand stock and mutual fund fair-price calculation in a simple way. It is a Progressive Web App (PWA) created and maintained by an individual developer based in India as a passion project. Kaash is not a company, startup, or registered entity.
The Platform helps users learn fundamental analysis and valuation through structured models, community research, and gamification. We comply with applicable Indian laws including the Information Technology Act, 2000.
Kaash is NOT a stockbroker, investment advisor, portfolio management service, or trading platform. We do not facilitate buying, selling, or holding of any securities. Using Kaash does not create a financial advisory, fiduciary, or professional relationship between you and the creator of this platform.
2. Eligibility
- You must be at least 16 years old to create an account.
- Users aged 16–17 must have verifiable parental or guardian consent to use the Platform. During registration, you will be asked to confirm that your parent or guardian has consented to your use of Kaash and the processing of your personal data.
- You must be a resident of India or accessing the Platform from a jurisdiction where its use is lawful.
- By using Kaash, you represent that you meet these eligibility requirements.
3. User Accounts
- You may sign in using Google OAuth, email OTP, phone OTP, or as a guest.
- You are responsible for maintaining the security of your account credentials.
- One person may have only one account. Multiple accounts may be suspended.
- Guest accounts have limited functionality and may be deleted after 30 days of inactivity.
- If you use the same email across different sign-in methods (e.g., Google + Email OTP), they will be linked to the same account automatically to provide a unified experience.
3A. Subscription Tiers & Free Trial
- Kaash offers a Free tier (always available, no payment required) and a Pro tier (paid subscription with additional research features).
- Users who sign up with Google OAuth may receive a complimentary 3-day Pro trial at the Platform's discretion. Trial availability may be modified or discontinued at any time.
- At the end of the trial period, Pro access is automatically downgraded to the Free tier unless the user subscribes to a paid plan.
- Pro subscriptions are processed through Razorpay. By subscribing, you also agree to Razorpay's Terms of Service.
- Subscriptions can be cancelled at any time. Access continues until the end of the current billing cycle.
- Refunds are not provided for partial billing periods.
- The first 100 paid Pro subscribers receive Founding Member status, a permanent designation with no additional monetary obligation beyond the subscription fee.
4. KPoints (KPoints) & Gamification
- KPoints (KPoints) are a virtual, non-monetary reward system used for engagement and learning.
- KPoints have no cash value and cannot be exchanged, transferred, sold, or redeemed for real money, securities, or any financial instrument.
- KPoints may be earned through creating valuation theses, voting, commenting, completing quizzes, maintaining streaks, and other platform activities.
- KPoints balances may be adjusted by the Platform at any time for system integrity, bug fixes, or policy changes.
- Conviction staking of KPoints is a gamification mechanic to test valuation accuracy. It does not constitute financial betting, wagering, or gambling under the Public Gambling Act, 1867 or any state legislation.
- Leaderboard rankings are for engagement and learning purposes only.
5. User-Generated Content
- You retain ownership of content you create (theses, comments, reactions).
- By posting content, you grant Kaash a non-exclusive, royalty-free, worldwide license to display, distribute, and promote your content within the Platform.
- You must not post content that is defamatory, obscene, misleading, or constitutes financial advice or stock tips under SEBI regulations.
- All valuation theses are educational opinions, not investment recommendations.
- User-generated valuation theses on Kaash do not constitute “research reports” as defined under SEBI (Research Analysts) Regulations, 2014, Regulation 2(1)(u). No user of Kaash is registered with or authorized by SEBI to publish research reports.
- We reserve the right to remove content that violates these terms or applicable law.
- Content is sanitized for security. Malicious content (scripts, injection attempts) will be removed and may result in account suspension.
6. Financial Disclaimers
IMPORTANT — READ CAREFULLY
- Kaash is an educational platform only. Nothing on Kaash constitutes investment advice, financial advice, trading advice, or any other sort of advice.
- All valuation models (DCF, Graham Number, PE Ratio, DDM, Price-to-Book, VR Score, Expense Analysis, Goal Alignment) are simplified educational tools.
- Fair prices, scores, and ratings generated by these models are hypothetical estimates for learning purposes.
- Kaash is not registered with SEBI as an investment advisor, research analyst, portfolio manager, or stockbroker under any SEBI regulations.
- You should always consult a SEBI-registered advisor before making any investment decisions.
- Past performance of any asset discussed on the Platform does not guarantee future results.
- Market data shown may be delayed and should not be relied upon for trading decisions.
7. Prohibited Activities
You agree not to:
- Use the Platform to provide paid investment advice or stock tips
- Impersonate any person, SEBI-registered entity, or financial institution
- Manipulate KPoints, leaderboards, or voting through automated means or multiple accounts
- Scrape, crawl, or extract data from the Platform without written permission
- Attempt to gain unauthorized access to other accounts, servers, or data
- Use the Platform for any unlawful purpose under Indian law
- Post spam, phishing links, or malicious content
8. Intellectual Property
- The Kaash name, logo, design, valuation models, gamification mechanics, and software code are the intellectual property of Kaash.
- The open-source components used in Kaash are governed by their respective licenses.
- You may not reproduce, distribute, or create derivative works of the Platform without permission.
9. Privacy & Data Protection
- Your use of Kaash is also governed by our Privacy Policy.
- We comply with the Digital Personal Data Protection Act, 2023 (DPDPA), the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
- For users aged 16–17, we process personal data with verifiable parental consent as required by DPDPA Section 9.
10. Account Termination & Deletion
- You may request deletion of your account at any time by contacting us via the in-app Feedback widget or email. We will process deletion requests within 30 days as required by DPDPA.
- We may suspend or terminate accounts that violate these terms, with or without notice.
- Upon termination, your KPoints balance is forfeited (it has no monetary value).
- Upon account deletion, your published theses will be permanently anonymized (authorship removed such that re-identification is not possible) and may be retained for community educational benefit. Anonymized content is no longer personal data.
11. Indemnification
You agree to indemnify and hold harmless Kaash, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your content, or your violation of any applicable law.
12. Limitation of Liability
- Kaash is provided “as is” without warranties of any kind, express or implied.
- We are not liable for any financial losses resulting from investment decisions influenced by content on the Platform.
- We do not guarantee the accuracy, completeness, or timeliness of market data or valuation calculations.
- Our total liability to you for any claims shall not exceed INR 1,000 (one thousand rupees).
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet disruptions, third-party service outages, or pandemic-related restrictions.
14. Dispute Resolution
- These Terms are governed by the laws of India.
- Any disputes shall first be attempted to be resolved through amicable negotiation within 30 days.
- If negotiation fails, the dispute shall be referred to a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, Karnataka. The language of arbitration shall be English.
- If arbitration fails or is not applicable, disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Platform (in-app notification). Continued use of Kaash after changes constitutes acceptance of the updated Terms.
16. General Provisions
- Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kaash regarding use of the Platform.
- Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
17. Grievance Officer
In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer can be reached via the in-app Feedback widget or the contact email listed in the Platform settings. We will acknowledge your grievance within 24 hours and resolve it within 15 days (or 30 days for complex matters).
